The service consists in provide access to the Welcome to the jungle online store, that besides of getting information about its products and services, allows the User, using the website, order the products that are available at the welcomethothejungle.pt e-commerce website, following this terms and conditions. The order should be made by users with an age of 18 and over. The user with less than 18, should have their parents or their representatives permission. The information transmitted by the user shall enjoy full legal effect, the user not being able to plead lack of signature for breach of undertaken obligations.

2. Product Information and Content

Welcome to the Jungle will do all the efforts in order that the presented information is free from typing errors. If the user had bought a product that has different features of those presented online, the user has the right to terminate the purchased contract due the legal terms (free resolution right – see point 7). Welcome to the jungle will make all the efforts to deliver the totality of the ordered products, however it’s possible that the company hasn’t the possibility to deliver the user requested products due situations that Welcome to te jungle cannot control, like, human errors or errors that occurred on informatic systems. If some product isn’t available after the order is made, the user will be notified by e-mail or by phone call to solve the problem. Welcome to the Jungle will be not responsible for any damages caused to the user or to third parties, by external factors which Welcome to the Jungle does not control, such as any failures, delays or communication suspensions from services provided by third parties, or for routers, cable modems, and possible computer virus that has origin on download of infected files or computer vírus or other proprieties that may affect the User’s device. Welcome to the Jungle will not be responsible for possible damages caused by the impossibilite of using our services in case of websites errors.

3.3 Data and Information consultations that have been done using these services, are presumed that were made by the user. Welcome to the jungle disclaims all responsibility caused by abusive use or fraud that have origin in the provided data.

3.4 Welcome to the Jungle disclaims any responsibility for any losses and damages caused by abusive use of services that were not directly intent, recklessly or by serious negligence.

3.5 Welcome to the Jungle disclaims any responsibility by any loss or damaged caused by Service defective compliance which Welcome to the Jungle were not directly responsible namely (i) erros, omissions or inaccuracies related to the information provided using the service; (ii) damages caused by users or third parties fault, including, intelectual propriety violations, (iii) by non-compliance or limited compliance that were driven of problems with compliance with judicial decisions.

3.6. Welcome to the jungle don’t assure that:
i) The service will be supplied without any possible interruptions, security failures, without erros or without termination;
ii) Quality of any product, service, information or any other good purchased using the Service will fulfill the user expectations;
iii) Any good that is purchased/acquired using the Service should be used is at the risk and peril of the user. The user is responsible by any damage caused to the user system and computer equipment or any loss of data resulting from the action/operation;
iv) ) Any advice or information, oral or written, obtained by the user or through the service will create any guarantee that is not described in Welcome to the jungle Terms and conditions;

3.7. The user accepts that Welcome to the Jungle can not, under any circumstances, be responsible for any damage, included, but no limited to damages such as loss of profit, data, content, or any other losses (even if Welcome to the Jungle have been notified by the User of the possibility of such damages), resulting of:
i) Utilisation or the impossibility of accessing the service;
ii) The difficulties of obtaining any substitute to goods/services;
iii) Unauthorised access or modification to personal databases;

4. Consumer Obligations

4.1. The user commits to:
i) Give correct personal data and addresses;
ii) Not use false identities;
iii) Respect the limit for orders designated by Welcome to the Jungle.

4.2. Welcome to the jungle will not be responsible by any delay or impossibility to processing the order, due to incomplete or insufficient data provided by the user. Welcome to the jungle has the right to not allow future purchases, block the user access to the online store and to all the services provided by Welcome to the Jungle and to stop any service provided at the same the time to the user, if the User violate the Welcome to the Jungle Consumer obligations.

4.3. It’s expressly forbidden the usage of Welcome to the Jungle products for comercial purposes, namely, the resale of goods acquired on Welcome to the Jungle Stores.

5. Privacy and Personal Data Protection

5.1. Welcome to the Jungle assures the confidentiality of all data provided by its customers/users.

5.2. The personal data identified on the order form as compulsory filling are essential for Welcome to the Jungle for providing its services. The omission or inaccuracy of data introduced by the user on the order form could lead to Welcome to the jungle denial for providing the service.

5.3. The personal data provided by user will be processed and stored by computer, and are destined to be used by Welcome to the Jungle for its comercial activity. The personal data will not be provided to third parties without previous notify the user.

5.4. The user can change or update the personal data provided to Welcome to the Jungle, under the terms of applicable legislation and without any costs, by itself or at written request. The user has the right to decline the usage of its personal data to third parties, and can notify Welcome to the Jungle anytime for that purpose.

6. Fulfilment of orders

To place an order, you must be registered on the Welcome to the Jungle website. After being registered on the website you must select the product you want and click on the product page. On the product page you must click add the product to the cart. After selecting all the products, you should click on your shopping cart located at the top right of the website and click on checkout. At the end of the purchase, an e-mail will be sent within 24 hours with the total value of your order and the details of the payment by bank transfer. You should make the bank transfer and then send the transfer receipt to encomendas@welcometothejungle.pt. An email will then be sent with the order confirmation and product shipping timing.

7. Returns (Withdrawal right)

7.1. The user, in case of being a consumer, is allowed in a 14-day period, starting made the purchase of the good, during which may withdraw from the contract with Welcome to the Jungle. To exercise this right, the user could use the contract draft described bellow, indicating all his personal data, the subscribed service that want to withdraw and the order subscription date. The consumer need to report during the period above by written letter and with the return of the purchased good, or using other appropriate means to notify Welcome to the Jungle.
After reporting the withdrawal, the consumer has 14 days to return the purchased good(s) in good conditions to Welcome to the Jungle.

Withdraw contract draft (Only fill-in and deliver the form if you want to cancel the contract):

- Name of the consumer
- Address of the consumer
- Signature of the consumer (only if this form is notified on paper).

The consumer should return the package, as it was delivered by Welcome to the Jungle. The consumer also need to return with the package, the following documents:
- Purchase Invoice and the delivery receipt.

The package and the documents should be send by mail to an address that will be provided by Welcome to the Jungle by e-mail, after the receive of the report to withdraw the purchase. The User will be responsible for all the shipping fees if he/she chooses to use other way not reported here to return the product.

7.2. After the returned purchase being receive, Welcome to the Jungle will refund the purchase value (Invoice value) to the User. The Refunded value will always be the value of the purchase.

7.3. The refund will be made thru the same payment method used by the consumer to purchased the good or the service. If the purchase was made using PayPal or credit card, the value will be credited on the users account. If the payment was made by bank transfer, Welcome to the Jungle will transfer the invoiced value to the user bank account. The refund will be made in a 14 days period after Welcome the Jungle received the withdrawl notification and the package return.

7.4. If the return product wasn’t delivered in perfect conditions or if any piece/feature is missing, Welcome to the Jungle has the right to not refund the product value and shipping fees and will resend the product to the users address.

8. Manufacturing Defect

8.1. In case of a "manufacturing defect", that is, when faults are detected in equipment that does not, in principle, fall within the scope of the guarantee, the User must return the equipment together with a copy of the invoice and the form "Order of Equipment Change/Return " completed, within a maximum of 30 consecutive days from the invoice date, to the address that Welcome to the Jungle sends you.
The User will be responsible for all the shipping fees if he/she chooses to use other way not reported here to return the product.

8.2. In order for the product to be exchanged, you must ensure that the packaging is complete (box, instruction manual, warranty certificate, terminal and accessories), containing all the components in excellent conditions.

8.3. In the absence of any of the elements mentioned above, or in case any of the components are not in excellent condition, there will be no Exchange and the product will be returned to the User again.

9. Product Warranty

9.1. Todos os equipamentos disponíveis na Loja estão devidamente certificados pelas entidades internacionais competentes.

9.2. The warranty period is defined by each product manufacturer, which is, according to legal term, two years minimum. To know period of warranty, the user should check the invoice date. To use the product warranty, the user need to present to Welcome To The jungle, the warranty document and/or the purchase invoice duly completed.

9.3. Equipment that has exceeded the period defined by the manufacturer or is defective due to abnormal wear, improper installation, electrical discharges, negligence or accident, improper handling, water / liquid infiltration, use of non-original accessories and technical interventions by unauthorised personnel is considered outside the warranty conditions.

9.4. If the equipment fails and if it is covered by the warranty, the User can go to a service center of the brand with the equipment and proof of purchase or warranty.

9.5. The accessories covered by the warranty that break down must be sent with proof of purchase and/or guarantee to the address that Welcome to the Jungle provides you.
The User will be responsible for all the shipping fees if he/she chooses to use other way not reported here to return the product. The User must always request a document from the transport companies that proves the sending of the order.

9.6. If the equipment is damaged and this damage is not found under warranty, the User can go to a service center of the brand with the equipment and proof of purchase.

Venda de animais
Welcome to the Jungle cares about the Animal Welfare, so the sale of the Animals is very selective and rigorous.
Some animals can’t be delivered to the new caretaker by regular carrier. After the agreement between Welcome to the Jungle and the User, Welcome to the jungle will contact the new Caretaker by phone or e-mail to arranje the proper way to delivery so it can assure the animals safety and welfare. Welcome to the Jungle do not accept the Animal Refund. When the user accepts the Animal, the user is responsible for the animal and Welcome to the Jungle do not accept the Animal Return. At the moment, the shipping of animals are only available to Portugal Continental and Rest of Europe.

10. Intellectual Propriety

10.1. The Online Store is an properly register website and Welcome to the Jungle is responsible for providing the service.

10.2. The user acknowledges that Welcome to the Jungle service contains classified information and its protect by copyright and related rights, intellectual propriety and other applicable legislation.

10.3. The User acknowledges that any advertised, featured product, promotion or any sponsor mentioned is protected by copyright and related rights, industrial propriety and related rights, and any use of the contente without further permission of Welcome to the Jungle is forbidden.

10.4. The User undertakes to respect the rights previous mentioned, namely abstain from any actions that would violate the law or the mentioned rights, such as reproduction, commercialisation, transmission or making available to the public the website contents or another unauthorised acts which address the same contents.

11. Service Safety Conditions

11.1. The user commits to comply with the legal provisions, namely do not practice or encourage illegal actions or offensive, such as spamming, violating the applicable legislation on the protection of personal data and to do not make advertising communication using an automatic calling machine. The User shall ensure comply the Website utilisation, under penalty of Welcome to the Jungle suspend or cease the service on the legal terms mentioned on point 14.

11.2. The user acknowledges and accepts that the IP network is a public network of electronic communications and is able to be used by many users, and because of that, can be liable to computer overcharges, wherefore, Welcome to the Jungle don’t assure the provision of services without, any interruption, informations losses or delays.

11.3. Welcome to the Jungle don’t assure the service provision in situations of impredectible overcharges on services provided by third parties.

11.4. Welcome to the Jungle commits to solving the problema as fast as possible in case of interruption of service provision caused by impredictable system overcharge.

12. Online Store Suspension or Deactivation

12.1. Welcome To The Jungle at his sole discretion has the right to deactivate the service to one or to all users anytime, whatever previous or further communication.

12.2. Welcome To The Jungle also has the right to suspend or end the service, on the following cases:
a) When the user do not comply with the conditions of use referred on point 4 or other referred general terms;
b) When Welcome to the Jungle cease store access through previous communication with 7 days in advance before the cease date.

12.3. The Use or Third Parties have no right to ask Welcome to the Jungle for compensation because of the services suspension or cessation as mentioned on the previous lines. Welcome to the Jungle can not be responsible or somehow burdened by any consequence caused by the service suspension, annulation or cancellation.

12.4. In the situations described above, Welcome to the Jungle will communicate within 3 workdays in advance to the User, so that the User can save is order page content. The communication will be send by e-mail or be displayed on the website homepage.

13. Welcome To The Jungle Communications/Notifications

13.1. Without prejudice to further communications under the conditions here mentioned, Welcome to Jungle may contact the user by e-mail, text message or phone with information regarding the service or possible changes to the terms and conditions.

13.2. The user accepts to receive all and any information and/or notification regarding the online store, to the User address, phone contact and/or e-mail that were provided in the order process. The User can at any moment, notify Welcome to the Jungle to stop sending communications and/or notifications, in order filling or by selecting the option “I don’t want to receive Welcome to the Jungle Newsletters” included in each newsletter.

14. Technical Settings

14.1. Without prejudice on next point, Welcome to the Jungle can change the Service and/or its technical settings related to the Service and also the usage rules. Welcome to the Jungle should inform the User about the changes at least 15 days in advance.

14.2. The existing and updated General Conditions and its attachments can be founded on Welcome to the Jungle website www.welcometothejungle.pt

15. Communications

15.1. Welcome to the Jungle can optimised and upgrade the network settings remotely whenever it feels necessary or convenient.

15.2. Without any prejudice and regarding the service innovation and technologic evolution, Welcome to the Jungle can change the website technical settings whenever it feels necessary to adapt to possible technological developments.

15.3. However, Welcome to the Jungle don’t assure any quality service upgrade or improvement to the User.

16. Complaints

16.1. The user can submit any contractual disputes to the arbitration mechanism and mediation that were or that will be legally constituted, as well as, complaint about acts or omissions that violate the applicable legal provisions to Welcome to the Jungle.

16.2. The complaint should be presented within a period not exceeding 30 days, calculated from the moment Welcome to the Jungle as aware of the User facts. The contractual disputes will be registered in Welcome to the Jungle Information Systems, which should decide the complaint and notify the interested in a 30 days period after the date of its reception.

17. Applicable Law

This agreement is governed by the Portuguese law.
